В своем интервью журналисту телеканала  CNBC Бобу Пизани, Глава Комиссии по биржам и ценным бумагам США (SEC) Джей Клейтон  заявил, что биткоин не является ценной бумагой и противопоставил его традиционным деньгам.

«Биткоин может заменить доллар, иену или евро, поэтому его нельзя отнести к классу ценных бумаг»

Он затметил, что токены, появляющиеся благодаря ICO, являются ценными бумагами, в то время как биткоин и подобные ему монеты таковыми назвать нельзя.

«Если я даю вам деньги, а вы создаете предприятие и передаете мне право на долю от совместного капитала, — то мы говорим о ценных бумагах. SEC регулирует предложения подобных ценных бумаг и торговлю ими»

По его словам, к ценным бумагам можно отнести токены, так как они выполняют роль цифровых активов и финрегулятор США контролирует эту сферу.

Ранее SEC официально инициировала исследование возможности регистрации в США биткоин-фондов ETF, путем изменения законодательства. При этом, появление биткоин-фондов предоставят институциональным инвесторам возможность добавить в свои портфели главные криптовалюты.
